Moneon — Terms of Service

Moneon is a mobile application for iOS and Android developed by Moneon (the "Administrator"). The application lets you manage and track your personal finances and analyze your transactions. Your use of Moneon, provided by the Administrator, is subject to the following terms (the "ToS"), which form a legally binding agreement between you and the Administrator without the involvement of any other party. You can download Moneon from the App Store and Google Play for free. Moneon offers in-app purchases (the "Premium package"), a set of features that extend the application's functionality.
Acceptance
These ToS govern the legal relationship between you and the Administrator. You should not use Moneon if you do not accept them. The ToS are always available to view and download within the Moneon application. You must also confirm your acceptance by selecting "I agree to the Terms of Service" when you create an account (the "Sign Up" process) in the application.
You should not accept these ToS unless you are at least 16 years of age. If you are 13 years or older but under 18 years of age, you must have your parent's permission to accept the ToS and use Moneon. If you are an EU citizen under 16 years of age, you should not accept these ToS.
Term and Termination
The ToS will remain in full force and effect while you use Moneon and until terminated by either you or the Administrator.
Termination always includes the deletion of your user account and all related data and content, unless your data and content have been shared with other users who have not deleted them.
You may terminate the ToS at any time and for any reason by sending written notice to the Administrator's address or e-mail and deleting the Moneon application.
The Administrator may terminate the ToS at any time and for any reason. In the case of immediate termination due to your breach of the ToS, you are not entitled to any refund.
Amendments
From time to time, the Administrator may amend the ToS at its sole discretion. You will be notified of any planned changes in advance through the Moneon application if those changes are significant. The updated ToS will be posted to this page 14 days prior to their effective date. By continuing to use Moneon, you express your acceptance of the changes. If you do not agree with the changes, you may terminate the ToS at any time.
The release of an updated version of the Moneon application may precede the effective date of the updated ToS for existing users. You may be required to accept the updated ToS in order to use all features of the updated version of the Moneon application.
Registration and User Account
You must use Moneon only in accordance with the ToS, for the purpose for which it was intended, and in compliance with all applicable laws and the terms and conditions of third parties.
In order to access Moneon, you must sign up. You agree to provide accurate, truthful and current information and to keep it up to date.
You must keep your Moneon account login information confidential and secure, and you may not share it with anyone. You are solely responsible and liable for any and all activity that occurs under your account.
The Administrator reserves the right to refuse your registration or suspend your Moneon account at any time.
User Content
You may enter into, upload to, or synchronize with Moneon text, numerical data, photos and other content. You retain copyright and all other rights to your content that qualifies for legal protection. For such content, you grant the Administrator a worldwide, non-exclusive, no-charge and royalty-free license to use it in connection with the provision of the services, including, without limitation, the rights to copy, reproduce, modify, create derivative works of, publish, display, upload, transmit, distribute, market and sublicense it. You represent that you have all the necessary rights and consents to do so. The license lasts for the full term of the copyright or until termination of the ToS.
You are solely responsible for any content you provide to Moneon and for any consequences thereof. You may not enter into, upload to, or synchronize with Moneon any unlawful content or content that infringes copyright or any other third-party rights. You may not upload any content that describes or depicts violence, or that is pornographic, discriminatory, racist, defamatory or otherwise illegal, or share such content with other users of Moneon.
The Administrator does not review user content but reserves the right to remove or disable access to any user content for any reason.
The Administrator is not responsible for the accuracy of the content you provide to Moneon or synchronize with it, or that Moneon creates based on your input.
You are solely responsible for backing up the content you enter into, upload to, or synchronize with Moneon.
Professional Advisor
Based on your user content, Moneon may provide you with personalized financial advice. You hereby acknowledge and agree that such financial advice or commercial offers do not constitute professional financial, tax, accounting or any other professional advice, and that the Administrator makes no representations or warranties of any kind in relation thereto. In no event shall the Administrator be liable for any damages caused to you or a third person arising out of your use of such financial advice or commercial offers.
License
The Moneon application and all rights therein, including intellectual property rights, shall remain the property of the Administrator or its licensors. Nothing in the ToS shall be construed to grant you any rights except for the limited license granted below.
Subject to the ToS, the Administrator grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use Moneon and its Premium package purchased pursuant to the ToS on any device that you own and control. The license is granted solely for your personal, non-commercial use. Accordingly, you may not rent, lease, lend, sell, transfer, redistribute or sublicense the Moneon application. Third-party services or libraries included in Moneon are licensed to you either under these ToS or under the third party's license terms, if applicable.
Under your license, you may not access Moneon by any means other than the mobile application; mine or extract any data from Moneon's databases; modify, reverse engineer, hack, decode, decrypt, decompile, disassemble or create derivative works of the Moneon application or any part thereof; or circumvent any technology used to protect the paid Premium features. You also may not remove, delete or obscure any copyright notices, proprietary labels or private legends placed upon or found within the Moneon application.
System Requirements
Information about the current hardware and system requirements of Moneon, technical restrictions and other limitations is always available on the platform-specific page of the application.
Maintenance and Support
Moneon is subject to continuous development, and the Administrator reserves the right, at its sole discretion, to update the Moneon application, change the nature of Moneon, or modify or discontinue any of its features without prior notice to you. You acknowledge that the Administrator has no obligation to maintain or update Moneon.
The Administrator does not guarantee uninterrupted provision of the services. Moneon or integrated third-party services may be temporarily unavailable due to maintenance, certain technical difficulties or other events beyond the Administrator's control.
If you have any questions, problems or suggestions, you can reach the Administrator via the contacts provided below. However, you acknowledge that support for non-paying users of Moneon is limited due to the Administrator's limited capacity.
Premium Package
The Moneon application is available for free. The free version allows you to use only the basic features of Moneon. You can unlock the Premium package through in-app purchases. The Premium package is unlocked by subscription. You can choose between a 1-month and a 12-month term.
Current detailed information about the in-app purchase offer is always available in the Moneon application.
Prices are displayed in your local currency (if supported) and always include the applicable VAT (Value Added Tax).
The Administrator does not guarantee that Moneon or any of its features will always be free, and reserves the right, at its sole discretion, to change the pricing at any time.
Downloading or using Moneon may incur additional costs for your Internet connection. You shall bear all such costs.
Payments and Refunds
You can purchase a Premium package subscription simply by pressing the "BUY" button in the platform's in-app purchase dialogue, which summarizes the billing type, price and term.
By pressing the "BUY" button, you enter into an additional contract pursuant to the ToS. Due to the method by which the contract is concluded, the text of the contract is neither saved nor accessible.
If you are a consumer whose normal place of abode or residence is in the European Union, by pressing the "BUY" button you also consent that contractual performance will start immediately, and you acknowledge that for this reason you lose your right of withdrawal.
Payment is due and payable immediately upon completion of the purchase process. Performance starts immediately after a successful transaction by unlocking the Premium package in Moneon. It is carried out by electronic means and is not subject to any extra fees.
If you purchase a subscription, it will automatically renew for another term of the same length unless you cancel it before the current term runs out. The subscription price is charged on the first day of the new term. You can cancel your subscription at any time. The cancellation will take effect the day after the last day of the current subscription term, and Moneon will be downgraded.
Refunds for in-app purchases are generally not provided by the Administrator.
For purchases made via Apple's App Store, the refund process is handled by Apple exclusively. We have no control over refunds for purchases made via the iTunes App Store, so such refunds remain entirely at Apple's discretion.
For purchases made via the Google Play Store within 48 hours, the refund process is handled by Google. You can find instructions on the Google Support portal.
Privacy
Some features of Moneon may be used only if you consent to the processing of your personal data. All information, including the extent and manner of processing your personal data, is set out in the "Privacy Policy", which forms an integral part of the ToS.
You can withdraw your consent at any time by deleting your Moneon account and the Moneon application.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE ADMINISTRATOR BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF USE, DATA OR PROFITS, PROPERTY DAMAGE, OR OTHER INTANGIBLE OR ECONOMIC LOSS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE MONEON AND INTEGRATED THIRD-PARTY SERVICES, ESPECIALLY DUE TO A REDUCTION IN AVAILABILITY, CANCELLATION OR MODIFICATION, HACKING ATTACKS, FAILURE, MALFUNCTION OR THE OCCURRENCE OF OTHER ERRORS IN THE OPERATION OF MONEON OR INTEGRATED THIRD-PARTY SERVICES, EVEN IF THE ADMINISTRATOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE LIMITATION ABOVE DOES NOT INCLUDE THE ADMINISTRATOR'S LIABILITY FOR FRAUD, MISREPRESENTATION, OR PERSONAL INJURY OR DEATH. IN NO EVENT SHALL THE ADMINISTRATOR'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED FIFTY U.S. DOLLARS ($50.00). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY, SO THIS LIMITATION MAY NOT FULLY APPLY TO YOU.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE MONEON APPLICATION AND INTEGRATED THIRD-PARTY SERVICES IS AT YOUR SOLE RISK, AND THAT THE ENTIRE RISK — IN PARTICULAR AS TO SATISFACTORY QUALITY, PERFORMANCE, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, SECURITY AND EFFORT — REMAINS SOLELY WITH YOU. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE MONEON APPLICATION AND INTEGRATED THIRD-PARTY SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES OF ANY KIND EXCEPT AS SET FORTH IN THE PRESENT ToS. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THIS DISCLAIMER MAY NOT FULLY APPLY TO YOU.
Export Control
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Governing Law and Disputes
Unless otherwise required by a mandatory law of any jurisdiction, the ToS, and any dispute or claim arising out of or in connection with them, their subject matter or their formation, shall be governed by the laws of the jurisdiction where the Administrator is established. All disputes shall be referred to the courts having substantive and local jurisdiction based on the address of the Administrator's registered office.
Severability
If any provision of the ToS is held invalid or unenforceable to any extent, this shall not in any way affect or render invalid or unenforceable the other provisions of the ToS. The provision shall be enforced to the fullest extent permitted by law, or deemed replaced by a provision that is valid and enforceable and that comes closest to the original intent and purpose.
Language
English is the primary language of communication between you and the Administrator. All information about Moneon is available in English. The ToS are available in English only. English shall also be the binding and controlling language for any additional contracts concluded pursuant to the ToS.
